Preamble

BCaster Oy (“BCaster”) respects your privacy. This Privacy Policy informs you of BCaster’s privacy practices and of the choices you can make about the way Personal Information about you, including from your online activity, is collected and how that Personal Information is used by BCaster. The term “Personal Information” comprises all information which allows or facilitates the identification of an individual.

BCaster is committed to protecting your Personal Information and your privacy.

All BCaster services are governed by this Privacy Policy and by using or accessing a service you give consent to the processing, use and disclosure of your data. Please do not install or use the Bcaster services if you do not agree to this Privacy Policy.

1. Collection of Personal Information.

BCaster recognizes the importance of the Personal Information by which you can be identified, such as your name, address, or e-mail address, your social network profile picture, your age, gender, your event pictures and/or other content, including without limitation the audio-visual recordings and other event content, you upload to BCaster’s service. BCaster respects the privacy of people visiting its websites and services. You may visit any of the BCaster websites without revealing any Personal Information.

The most probable means on how your Personal Information may be collected by BCaster includes (i) by using BCaster’s mobile apps or visiting BCaster websites, (ii) registration for BCaster services; (iii) accessing Services using a third party ID, such as social networking sites; (iv) subscribing to BCaster newsletters; (v) using social features of the applications or web sites such as “tell a friend about BCaster,”; (vi) requesting technical support; and (vii) through any use of BCaster services where personal data is required for use and/or participation.

Please note that certain features of the services, including registering to the services by using social networks, may be able to connect to your social networking sites to obtain additional information about you.

There is not any obligation for you to provide BCaster with your Personal Information; however certain functionalities of services or websites are or may be limited to be available only for registered users consenting to the processing of their Personal Information. In general, BCaster collects only Personal Information that you voluntarily provide, for example, when you upload content, provide a comment or send feedback. Both the type and amount of Personal Information collected will be limited to information that is relevant to the identified purposes and is obtained by lawful and fair means, consistent with applicable Data Protection Legislation.

BCaster saves your Personal Information only for as long as necessary to fulfil the identified purposes as well as to comply with applicable Data Protection Legislation.

Location Data

When and if BCaster makes available services enabling location tracking or other location data (such as movement, acceleration and other types of spatial data, depending of the sensors of your device) and you use such services, BCaster may collect and process your location and other spatial data to provide related Services. Location data may also be used to provide you location-based advertisements. For example, some sub-services, add-ons or offers may be available at dedicated locations only and for users consenting the use of their location data. The location data is processed and stored only for the duration that is required for the provision of the location related Services.

BCaster may use, depending on the service, (1) accurate geo-location data based on data (such as location, movement and other spatial data) obtained from your device’s GPS location sensors and other sensors enabling the gathering and processing spatial data, or (2) coarse, network-based location data based for example on proximity of network towers or the location of WiFi networks.

Your accurate sensor-based geo-location is not accessed without your consent. Notwithstanding BCaster partners who are providing location related parts of the Service, BCaster will not share your GPS geo-location with third parties without your consent. To the extent BCaster makes available GPS geo-location to third parties in accordance with this Privacy Policy, it will be provided anonymously.

Cookies, Web beacons and other technologies

BCaster collects information about visitors to its services via the use of cookies, web beacons and other technologies in order to further improve its services and online offers. In this way, customer needs can be better met by BCaster by telling it which visitors clicked on which parts of its website, as well as to recognise your browser the next time you visit a BCaster website.

Accordingly, BCaster websites may occasionally send "cookies" to your computer to better serve you with more tailored information when you return to the website. Cookies are small text files that are downloaded and stored on your computer when you visit a BCaster website. They can either be just for the period of time, or session, when your web browser is open to a BCaster website, or they can be persistent cookies that store your preferences for future visits to the website.

“Web beacons” are an electronic image which can recognise certain types of information, such as website usage. They are often combined with cookies. Web beacons may identify a visit, but will not be able to correlate it with any cookies’ information.

Some jurisdictions may require your consent before serving cookies and similar tracking devices to your computer, such as prior consent, or where consent can be inferred through appropriate browser / application settings or other means.

You may refuse the use of cookies by selecting the appropriate settings on your browser; for example you can always set your browser to tell you when you are sent a cookie and then refuse to receive it. And you can always delete the cookie at any time that you want.

However, please note that if you do this you may possibly not be able to use the full functionality of the BCaster services.

On some pages of our site, third parties may also set their own anonymous cookies, for the purposes of tracking the success of their application or customising the application for you. We cannot access these cookies, nor can the third parties access the data in our cookies.

Google Analytics

Websites of BCaster may make use of different analytics, such as (but not limited to) Google Analytics, which is a web-based analysis service of Google Inc. ("Google"). Google Analytics uses cookies, which are stored on the user's computer and which allow an analysis of the use of the BCaster website by you. The information generated by the cookie about the users' use of the BCaster website is generally transferred to one of Google's servers in the USA and is stored there. Anonymisation of the user’s Internet Protocol (IP) has been activated on the Google website, so that – beforehand – the user's IP-address will be shortened by Google in the country of origin. Only in exceptional cases will the full IP-address be transferred to a Google server located in the USA and shortened there.

Google will use this information to evaluate the user's use of the BCaster website, in order to put together a report about the website activities. In no circumstances will Google associate your IP address transmitted by your browser with other data stored by Google. Nevertheless, you can prevent the installation of the Google cookies with the appropriate setting of your browser.

2. Use of Personal Information

BCaster will only use your Personal Information for the purposes made known to you, or to which you have consented in advance by accepting the End User Terms. These purposes include (but may not be limited to) publication, modification and exploitation of the audio-visual content uploaded by you, answers your questions or responses to your feedback, providing information requested by you, communicating with you regarding BCaster’s products and service, or communicating with you in order to prevent and detect security threats, fraud or other malicious activity.

In addition, BCaster may use the Personal Information when legally necessary in order to: protect its legal rights, protect it against claims and lawsuits, comply with court orders or orders by law issued from a public authority, or where otherwise required or permitted by applicable laws.

Advertising/Marketing and Public Opinion Surveys

BCaster or its partners may display to you behaviorally targeted advertising. BCaster may use and disclose the collected, non-personal data (or personal data made non-personal by removing identifiable components) for purposes of advertising, whether by BCaster or BCaster’s partners. BCaster may also employ third party advertising technologies that use certain methods to collect information as a result of advertising through services. The parties operating the services and the technology process and use your Personal Information, especially location-based information as well as person-related (for example age) information entered into BCaster services from your device or other hardware, to ensure that the advertising presented to you within the service is relevant. The advertisement services provider may for such purposes collect and use data such as IP address, device type and its unique identification code, installed operating system, software and applications, application usage data, hardware type (eg. phone/tablet/PC/other), and network usage information.

The foregoing data may be used and disclosed in accordance with this Privacy Policy and the privacy policy of the company providing the advertisement technology.

Some services may also include the use of brand placement, which will be noted as such within the services.

You may decide to "opt-out" of targeted advertising. In such case, please visit www.youradchoices.com and/or www.networkadvertising.org. You should note that even if you enter your request to opt-out to the sites mentioned herein, the request may not reach all BCaster’s advertising partners, and that some of targeted advertisement may be based to information obtained elsewhere, beyond BCaster’s control. Certain targeted advertising may therefore be displayed to you despite your request.

If you want to be certain that no targeted advertisements are displayed to you, please do not use or access the services.

Please note that if you “opt out” it does not mean that you will no longer receive advertising. It simply means that the advertising you will see will not be customized to you.

3. Disclosure to Third Parties

BCaster may disclose your Personal Information to its affiliates, strategic partners and service partners who assist BCaster in providing its products and services to you. Also, if BCaster determines the need to sell, buy, merge, or reorganise its business, it may also need to disclose your Personal Information for such business reasons, but will pursue relevant and proper protection of your Personal Information in such an event.

In addition, disclosures may be required for legal reasons. However, your Personal Information will not be shared with third parties for advertising or marketing purposes without your prior consent. Also, BCaster does not sell or lease your Personal Information. But as a reminder, please note that any Personal Information that you may have already shared with others from any of BCaster’s online services – or for example in social networks – cannot be kept private or confidential.

BCaster may, for example in order to secure the proper functionality of its services and to ensure its user may enjoy the desired quality of the services, use and engage contractors or partners outside European Union (EU) or European Economic Area (EEA) and to disclose Personal Information to such third parties. Personal Information may be disclosed to such third parties located outside the EU or the EEA in accordance with applicable legislation and this Privacy Policy.

4. Security

Your Personal Information will be protected by reasonable security safeguards against accidental loss, unauthorised processing, the destruction of, or use or modification of, or unauthorised disclosure of your Personal Information. BCaster employs appropriate technical and organisational security measures in order to protect your Personal Information. The safeguards BCaster employs are proportionate to the likelihood and severity of any potential harms or threats, the sensitivity of the Personal Information, and the context in which it is held.

5. Retention of Personal Information

BCaster will use Personal Information that you provide (e.g. during registration with BCaster’s website, application or other services, due to your use of BCaster services or for example by calling customer service phone) only for the purposes as listed in sections 1, 2 and 3 above. Consequently BCaster will retain your registered Personal Information only for as long as needed to provide you with the requested services, unless a longer retention period is required or permitted by law. In particular BCaster will retain and use your registered Personal Information as necessary to comply with its legal obligations.

6. Children

BCaster respects the privacy of children and does not knowingly collect, use or disclose Personal Information of minors under 12 years of age without verifiable consent from a parent or guardian.

If BCaster becomes aware that the information submitted to BCaster is Personal Information of a minor without firstly receiving verifiable consent from a parent or guardian, BCaster will take immediate steps to delete such Personal Information.

7. Links to other sites

BCaster does not collect Personal Information from third party sites, with the exception of social networking sites related to which you have at the time of your registration to BCaster services consented to. In the event that BCaster should somehow receive your Personal Information from a third party site, BCaster will request your permission before collecting, storing and processing it.

Also, please be advised that websites that are linked directly or indirectly from this website (the "Linked Sites") may not be operated or maintained by BCaster. If you have connected with any Linked Sites, BCaster has no control over the collection, storage or processing of your Personal Information that may be transferred to the third party (e.g. the IP address or the URL of the website containing the link), as naturally, BCaster does not have any control over the behavior of such third parties. Accordingly, BCaster disclaims liability for access to, and use of, any Linked Sites, and will not be responsible for the privacy practices of those Linked Sites.

8. Questions or Concerns

BCaster is committed to ensuring that the Personal Information it holds is accurate, complete, and kept up-to-date to the extent necessary for the relevant purpose. If you wish to rectify inaccuracies or delete Personal Information relating to you, or view or update your Personal Information, or if you have any questions, comments or concerns about this Privacy Statement, or if you wish to make a complaint about BCaster’s handling of your Personal Information or a possible breach of privacy laws then please contact BCaster at: contact@bcaster.com or BCaster Oy, Karhumäentie 3, FI-015330 Vantaa, Finland, European Union.

For privacy protection purposes, you may be asked to provide proof of identification and other relevant details.

9. Changes to the Privacy Policy

This Privacy Policy may change from time to time by posting an updated version on BCaster’s website, thereby superseding earlier versions. If there are changes that materially alter its privacy practices, BCaster may also notify you by other means, such as by email, in-app notification, or by posting a notice on BCaster’s website and / or social media pages in reasonable time prior to the date that the changes take effect. In particular, if BCaster intends to use your Personal Information in a manner different from that stated at the time of collection, BCaster will notify you, and you will be given a choice to permit or disallow such use.
